These Terms and Conditions outline the rules and regulations for the use of our website located at www.giftedhampers.co.uk and for the purchase of any product from said website.By accessing and continuing to view this website and/or by ordering from said website we assume that you accept and agree to be bound by these terms and condition’s together with our privacy policy.

1. Introduction You will be able to view and access most areas of this website without having to register your details to do so. Some aspects of the website are only accessible to you once you have registered an account.

1.1We reserve the right to update or revise these terms and conditions at any time by updating this posting. The current terms and conditions should be reviewed by yourself at the time of using this website as they are binding on you, you should print a copy of these terms and conditions for your future reference. If you do not wish to be bound by or agree to these terms and conditions, then you should not continue to use this website.

1.2By placing an order through this website you authorise and declare the following:

• You are at least 18 years old • You are a resident in one of our served countries • You are legally capable of entering into a binding contract • You agree to internal record keeping

2.Ordering and Contract Formation Your order constitutes an offer to buy. All orders are subject to availability and acceptance by us, your order is only accepted once we send you an email confirming that your order has been dispatched.The binding contract between us is only formed after we send you confirmation that your order has been dispatched.

2.1We will not process your order until full payment has been received by us according to our price and payment terms outlined in clause 3.

2.2The contract only applies to the part of the order where products have been confirmed by us to have been dispatched. We are not obliged to supply any other part of your order and are not bound by any contract until such products are confirmed by us to have been dispatched separately.

2.3 By placing an order you affirm that all details you supply are true and correct at the time of ordering. You confirm that you are the authorised user of any debit or credit card used for part or full payment of the order.

2.4It is your responsibility to inform us of any changes to your ability to pay and we reserve the right to refuse or decline any order made by you for any reason.

2.5 All prices are displayed in GBP (£) and include VAT where applicable.

2.6 We make every effort to display product colours and packaging accurately; however, actual colours may vary depending on your monitor settings.

2.7Substitutions: In the event that a specific item in a hamper is unavailable, we reserve the right to substitute it with an item of equal or greater value that fits the theme of the hamper. We will endeavour where possible to inform you of any such substitutions by email prior to dispatching your order.

2.8Where it is the case that we cannot obtain authorised payment for your order no goods will be dispatched. Where you do not meet the criteria outlined in our terms and conditions no goods will be dispatched. Where products become unavoidably unavailable no goods will be dispatched.

3.Price and Payments Prices for each product are displayed on the website in GBP (£) including vat but excluding delivery charges which are shown separately when selecting a delivery option. All delivery charges must be paid in full at the time of ordering unless otherwise specified.

3.1We must receive cleared funds for the full payment amount of your order including delivery charges before any dispatch confirmation is made by us.

3.2It is not always possible to ensure that all products are not listed with an incorrect price, where a product is priced lower than the published price we will provide the product at the lower price. Where a product is priced higher than the published price on our site, we will endeavour to contact you to inform you in this regard and await your instruction. We may on occasion decline the order and notify you in this regard.

3.3We reserve the right to amend our prices as we see fit and are under no obligation to provide any product to you for an incorrect (Lower) price where a pricing error is obviously incorrect and can be easily recognised by you as a mistake.

3.4Where any promotional code is offered only one per order may be applied. All prices and promotional offers are subject to change at any given time. All advertised prices are subject to change.

3.5Any promotion or promotional code can only be used one per person.

3.4Payments must be made in GBP (£) no alternative can be accepted and payment must be made using an approved debit or credit card.

4.Delivery We deliver to addresses within the mainland UK and Northern Ireland.Delivery timescales are estimates and cannot be guaranteed by us.

4.1It is the customer's responsibility to provide a correct and complete delivery address. We cannot be held liable for failed deliveries due to incorrect information.

4.2If an order contains perishable goods, it is the recipient's responsibility to ensure someone is available to receive it.

4.3We can deliver our gifts to mainland uk and Northern Ireland only. We cannot deliver to P.O. Box addresses or Channel Islands. Deliveries to remote locations and offshore islands in Scotland, Northern Ireland and other remote uk locations will take longer than usual. Please allow extra 2-3 days for delivery.

4.4Deliveries are usually made Monday to Friday between 8.00am and 5.30pm it is not possible to guarantee or select an exact delivery time. Once goods are in the hands of our delivery partners you will be contacted by them with their delivery information.

4.5If the parcel is unable to be delivered and is taken to a pickup shop/point or depot and is not collected by the addressee in a specified time frame,it will be returned by the carrier to Gifted Hampers. There after if you require the goods to be resent a re delivery charge will be issued to you. If you wish to cancel the order after the goods have been returned to us a refund will be issued for the value of the goods only. You will be charged if any of the return goods have become unsuitable for resale such as perishable food items.

4.6Deliveries to establishments such as hospitals, businesses, universities or hotels will need to be verified by you the customer before placing your order. Please contact the establishment prior to ordering from us to check their delivery policy. Our delivery partner can only deliver goods to a main reception or goods-in department and not directly to the recipient. Once accepted and signed for it will be the responsibility of that establishment to ensure the goods are passed on to the individual addressee.

4.7Where the goods have been left at a customers elected safe place or neighbour it is their responsibility to collect the goods within a reasonable time.

5.Cancellations and Returns We want you our customer to be completely satisfied with your purchase and the service we offer. You have the right to change your mind and return an order within 14 days of the date the order is received by you.

5.1Please contact us by email at returns.giftedhampers@gmail.co.uk to inform us of and arrange a return. Please use the return address label attached to your invoice note this is not a prepaid label.

5.2 Important the original invoice accompanying the order must be enclosed with your return to allow us to identify the order and process your refund. Without the original invoice your refund may take longer to process.

5.3Hampers, gift boxes and orders must be returned in full in the original packaging, unopened and in a re saleable condition.

5.4We recommend you use a tracked service for your returns. We will not be held liable for any lost or missing return items. Please obtain and keep proof of your postage.

5.5Right to Cancel: Under the Consumer Contracts Regulations, you have 14 days to cancel your order from the day you receive the goods. Exceptions: The right to cancel does not apply to:Perishable goods (food/flowers with a limited shelf life). Any personalised or bespoke items, where the seal has been broken (for hygiene or health protection reasons).

5.6Faulty or Damaged Goods: if your order arrives damaged or items are faulty, please contact us within 48 hours of delivery with photographic evidence. We will arrange for a replacement or a full refund in accordance with your legal rights under the Consumer Rights Act 2015.Where an individual item is affected that sole item will be replaced and not the entire hamper. We will require damaged or faulty goods to be returned to us to provide a refund.

6.Allergens allergen information is provided on individual products labels and ingredients descriptions within the hampers. It is the recipient's responsibility to check labels before consumption. We cannot guarantee that any products are free from traces of nuts or other allergens.

7.Limitation of Liability We are not liable for any indirect losses or for any business losses (loss of profits, etc.). Our total liability shall not exceed the price of the goods purchased. We are not liable or responsible for any amount of loss or damage that may result to you or any third party ( including but not limited to any direct or indirect loss or damage, loss of income, profit, data, goodwill, contract or any loss or damage connected to or arising from business interruption) in connection to your use of this website in any way. 

7.1If your use of this website and materials contained in this website results in any need for repair or modification, correction or servicing of your equipment or data or software, you assume all costs thereby incurred.

8.Service Access We strive to ensure that this website is normally accessible 24 hours per day, we will not be liable if for any reason this website is unavailable for any reason for any given amount of time.

8.2 Whenever deemed necessary this website may be unavailable or temporarily unavailable due to system maintenance or repair or for any unforeseen reason which is out of our control.

9.Governing Law These terms and conditions are governed by English law, and any disputesarising in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of England.

9.1We do not warrant that any products or items available for sale on our website are appropriate or approved for sale or use outside the UK.It is prohibited to access our website from any territory or country where the contents of the website are deemed illegal or prohibited or unlawful. If you access this website from outside the UK, you will do so at your own risk.

10.Registration and Security To access certain features of this website it may be necessary to register for an account. By creating an account you agree to the following terms:

10.1Each registration is for a single person user only. We do not permit you to share your user account and password with another person or multiple users on a network.

11.Miscellaneous You may not sub-license or transfer your rights under the terms and conditions of this website.

11.1You are permitted to print or download images, information or extracts from this website for your own private use under the following but not limited to conditions:

• No graphic or documentation is modified in any way • All of our copyright and trademark notices are presented in all copies • No graphic is used separately from the accompanying text

11.2Unless otherwise stated all intellectual property rights and or copyright for all materials contained in this website are owned by us Gifted Hampers or our licensors and partners. Returns & Refunds Policy

Returns & Refunds Policy

At Gifted Hampers we want you and your recipient to be delighted with your gift. If there is a problem with your order, we are here to help.

1. Your Right to Cancel (Change of Mind)

Under the UK Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receiving your goods.

How to notify us: Please email us at returns.giftedhampers@gmail.co.uk inform us of your decision to cancel.

Condition: Items must be returned in their original packaging, unopened, and in a resalable condition. Where a hammer or gift box is being returned the entire contents of the hamper should be returned also in the original packaging, unopened and in a resealable condition.

IMPORTANT: please enclose the original invoice with your returned item, this allows us to identify your order and process your refund without this invoice your refund may take considerably longer to process.

Refund: We will refund the full cost of the hamper plus the standard delivery charge within 14 days of receiving the goods. You are responsible for the cost of return postage, and we advise you to obtain and keep proof of postage. We also advise you use a tracked postage service to return your item.

We will not be held liable for any lost or damaged return items. Please retain your proof of postage.

2. Exceptions: Please note that the right to cancel does not apply to the following items unless they are faulty or damaged:

• Perishable Goods: Hampers containing any fresh food item.

• Personalised Items: Any items that have been personalised to your specification. Any bespoke item.

• Sealed for Hygiene: Items where a hygiene seal has been broken. Please note earrings are nonreturnable for hygiene reasons.

• Alcohol: If the price was dependent on fluctuations in the financial market which cannot be controlled by the retailer.

3. Damaged or Faulty Goods

We take great care in packaging our hampers, but if an item arrives damaged, faulty, or not as described, please contact us within 48 hours of delivery.

• Evidence: Please provide your order number and photos of the damage (including the external packaging).

• Resolution: We will offer a full refund for the damaged item, or a replacement at no additional cost to you.

4. Gifts

If you received a hamper as a gift and it is faulty, we can offer an exchange. If a refund is required for a gift purchase, it will be issued to the original purchaser via the original payment method and not to the recipient of the gift.

5. Returns Address please attached the returns label from the bottom of your invoice to your parcel note this is not a prepaid label and the cost of returns is paid by you.
